These Terms and Conditions (“Terms”, “Agreement”) constitute a legally binding contract between you(“User”, “Member”, “you”, or “your”) and Sawa Technologies Private Limited, a company incorporated under the laws of India (“Sawa”, “Company”, “we”, “us”, or “our”). These Terms govern your access to and use of the Sawa mobile application, website available at https://sawa.living, and all related features, content, software, and services (collectively, the “Platform” or “Services”). By accessing, downloading, registering for, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, whether or not you create an account. If you do not agree with these Terms, you must immediately discontinue use of the Platform.

  1. INTRODUCTION AND PURPOSE OF THE PLATFORM

Sawa is a private social networking platform created exclusively for adult couples, including coupleswith children, to foster meaningful social connections, community engagement, shared experiences, and real-world interactions in a respectful, safe, and family-conscious environment.

Sawa is not a general dating platform, is not intended for single individuals, and does not facilitate casual dating, hookups, or matchmaking between unpartnered users. Any use of the Platform inconsistent with its intended purpose is strictly prohibited.

  1. ELIGIBILITY, AGE REQUIREMENTS, AND LEGAL CAPACITY

You may access or use the Platform only if:

1. You are at least 18 years of age

2. You possess the legal capacity to enter into a binding agreement under applicable law

3. You are not barred from using the Services under any applicable law or regulation

4. You comply with these Terms and all applicable local, state, national, and international laws


Minors are strictly prohibited from creating accounts or independently accessing the Platform. Parents or guardians are solely responsible for any content involving children that they choose to share.

  1. ACCOUNT REGISTRATION, ACCURACY, AND SECURITY

3.1 Account Creation

To access certain features, you must create an account and provide truthful, accurate, current, and complete information. You agree not to misrepresent your identity, relationship status, or any other material information.


3.2 Account Responsibility

You are solely responsible for:


  1. All activity conducted through your account

  2. Maintaining the confidentiality of your login credentials

  3. Ensuring that your account is used only by you


Sawa is not responsible for any loss, damage, or unauthorized activity resulting from your failure to secure your account.

  1. COUPLE ACCOUNTS AND LINKED PROFILES

Sawa allows users to link accounts with their partner to enable shared or connected features. By linking accounts, you acknowledge and agree that:


  1. Both partners have provided informed, voluntary, and revocable consent

  2. Certain information, content, and interactions may be visible to the linked partner

  3. Each partner remains individually responsible for their conduct

  4. Sawa does not mediate relationship disputes, separations, or disagreements


    Either partner may unlink the accounts at any time without the consent of the other.

  1. MEMBER CONSENT AND AUTONOMY

By using the Platform, you expressly consent to:

  1. Being discovered by and interacting with other members

  2. Receiving communications initiated by other users

  3. Sharing profile information according to your selected privacy settings

  4. Receiving operational, security, and service-related communications from Sawa


You may withdraw your consent at any time by adjusting your settings or deleting your account; however,

withdrawal of consent may limit access to certain features.

  1. CONSENT IN USER INTERACTIONS

Sawa is built on the principle of mutual respect and consent.

You acknowledge that:

  1. All interactions must be voluntary and consensual

  2. Consent may be withdrawn at any time

  3. Harassment, coercion, manipulation, or intimidation is prohibited

  4. Sawa does not control or oversee offline interactions


Any interaction that occurs outside the Platform is undertaken entirely at your own risk.

  1. MEMBER RESTRICTIONS AND PROHIBITED CONDUCT

You agree that you will not, directly or indirectly:

  1. Harass, threaten, abuse, stalk, or defame others

  2. Post or distribute sexually explicit, pornographic, violent, hateful, or discriminatory content

  3. Engage in conduct that exploits, endangers, or harms children

  4. Solicit money, gifts, donations, or financial assistance

  5. Promote scams, pyramid schemes, or illegal activities

  6. Impersonate any person, organization, or authority

  7. Use automated tools, bots, or scraping technologies

  8. Circumvent moderation, reporting, or security mechanisms

  9. Collect, store, or misuse personal data of other users


Sawa reserves the right to take immediate enforcement action for violations.

  1. CHILD SAFETY AND FAMILY PROTECTION POLICY

Sawa maintains a strict commitment to child safety.

You represent and warrant that:


  1. You are the parent or legal guardian of any child featured in your content

  2. You will not disclose sensitive personal information of minors

  3. You will not post content that is exploitative, sexualized, or harmful


Sawa maintains a zero-tolerance policy toward child sexual exploitation or abuse and will report

violations to appropriate authorities.

  1. USER CONTENT, OWNERSHIP, AND LICENSE

9.1 Ownership

You retain ownership of all content you submit, post, or upload (“User Content”).


9.2 License Grant

By submitting User Content, you grant Sawa a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, display, modify, and distribute such content solely for the purposes of operating, improving, marketing, and securing the Platform.


9.3 Content Responsibility

You are solely responsible for your User Content and represent that it does not violate any law or third- party rights.

  1. CONTENT MODERATION AND ENFORCEMENT

10.1 User Content Responsibility

You are solely responsible for all content you upload, post, transmit, share, or otherwise make available on the SAWA platform (“User Content”). You represent and warrant that you own or have the necessary rights to use and share such content and that it does not violate these Terms or applicable law.


10.2 Right to Monitor and Remove

SAWA reserves the right, but has no obligation, to monitor, review, edit, restrict, or remove any User Content at any time and for any reason, including content that SAWA believes violates these Terms, applicable law, or community standards.


10.3 No Endorsement

SAWA does not endorse, support, represent, or guarantee the accuracy, legality, or quality of any User Content. The presence of content on SAWA does not imply approval by SAWA.


10.4 Enforcement Actions

SAWA may take any enforcement action it deems appropriate, including issuing warnings, limiting visibility, suspending features, removing content, suspending accounts, or permanently terminating accounts, without prior notice.


10.5 Repeat Infringers

SAWA may terminate accounts of users who repeatedly violate these Terms, intellectual property rights, or platform policies.


10.6 Cooperation with Authorities

SAWA may cooperate with law enforcement, regulators, or legal authorities and disclose information as required by law or to protect SAWA, its users, or the public.


10.7 No Obligation to Publish

SAWA is not obligated to host, display, or distribute any User Content and may refuse service to anyone for any lawful reason.


10.8 Appeals

Where required by law, SAWA may provide a process to appeal moderation decisions, but SAWA retains final discretion on enforcement actions.

  1. BACKGROUND CHECK AND USER VERIFICATION DISCLAIMER

11.1 No Guarantee of Verification

SAWA may, but is not obligated to, conduct background checks, identity verification, or screening of users. SAWA does not guarantee that any user is who they claim to be, or that they have been vetted, verified, or approved by SAWA.


11.2 User Responsibility

You acknowledge that interactions with other users are at your own risk. SAWA is not responsible for the conduct, behavior, accuracy of information, or legality of any user on the platform.


11.3 No Criminal History Representation

SAWA does not represent or warrant that any user has no criminal history, has undergone background screening, or is suitable, safe, or appropriate for interaction.


11.4 No Liability for User Actions

SAWA is not liable for any loss, harm, injury, damage, or dispute arising from interactions between users, whether online or offline, including meetings, transactions, communications, or collaborations.


11.5 Independent Judgment Required

You agree to use your own judgment and take reasonable precautions when communicating or engaging with other users. SAWA encourages users to report suspicious, abusive, or unsafe behavior.


11.6 Verification Features Are Informational Only

Any verification badges, labels, or indicators provided by SAWA are for convenience only and do not constitute an endorsement, certification, or guarantee of a user’s identity, character, or reliability.


11.7 Changes to Verification Practices

SAWA may modify, suspend, or discontinue any background check or verification processes at any time without notice or liability.

  1. SAFETY DISCLAIMER

Sawa Technologies Private Limited does not guarantee the identity, intent, conduct, or behavior of any user on or off the Platform. You acknowledge that all interactions with other users—whether online or offline—are undertaken entirely at your own risk. Sawa does not supervise, control, or monitor in-person meetings or off-platform communications and expressly disclaims any responsibility or liability for any injury, harm, loss, damage, assault, harassment, fraud, or other adverse outcome arising from interactions with other users. You agree to exercise independent judgment, personal responsibility, and reasonable precautions, including meeting in public places, informing trusted contacts, and discontinuing interactions that make you uncomfortable.

  1. PRIVACY AND DATA PROTECTION

Sawa collects, processes, stores, and protects personal data in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023, and related rules. Personal data is collected only for lawful purposes such as account creation, service delivery, safety, fraud prevention, customer support, analytics, and platform improvement. Sawa implements reasonable technical and organisational safeguards to protect data against unauthorised access, misuse, alteration, or loss. Users may have rights to access, correct, update, withdraw consent, or request deletion of personal data, subject to legal and operational limitations. Detailed practices are described in the Privacy Policy, which is incorporated by reference and forms an integral part of these Terms.

  1. PAYMENT TERMS

Certain features of the Platform may require payment, including subscriptions, premium services, or virtual items. All payments are processed through third-party payment service providers and are subject to their terms.

Subscriptions may automatically renew unless cancelled prior to the renewal date. Fees are non- refundable except where required by applicable law. Prices, billing cycles, promotions, free trials, taxes, and payment terms may vary and may be modified by Sawa upon reasonable notice. You are responsible for all applicable taxes, charges, and fees associated with your purchases.

  1. VIRTUAL ITEMS

15.1 Definition

Virtual Items are digital products or features offered within the SAWA platform, including but not limited to virtual goods, credits, points, tokens, subscriptions, badges, and other in-app content (“Virtual Items”).


15.2 License, Not Ownership

When you obtain Virtual Items from SAWA, you receive a limited, personal, non-exclusive, non- transferable, revocable license to use them solely within the SAWA platform. Virtual Items have no real- world value and do not constitute property or currency outside the Service.


15.3 Non-Transferable

Virtual Items may not be sold, transferred, gifted, exchanged, sublicensed, or redeemed for cash or real- world goods, except where expressly authorized by SAWA in writing.


15.4 No Refunds

All purchases or acquisitions of Virtual Items are final and non-refundable, except where required by applicable law. Lost, unused, or deleted Virtual Items will not be replaced or refunded.


15.5 Modification and Removal

SAWA reserves the right, at any time, to modify, manage, control, suspend, or remove Virtual Items without liability. SAWA may also adjust pricing, availability, or functionality of Virtual Items at its sole discretion.


15.6 Account Termination

If your account is suspended, terminated, or closed for any reason, you may lose access to all Virtual Items associated with your account without compensation.


15.7 Prohibited Use

You agree not to exploit Virtual Items, including by attempting to hack, duplicate, manipulate, reverse engineer, or use them in any unauthorized manner. Any misuse may result in immediate account suspension or termination.


15.8 Payment and Errors

You are responsible for all charges related to Virtual Items. SAWA is not responsible for losses caused by unauthorized access to your account. If a technical error grants Virtual Items improperly, SAWA may correct the error and remove the affected items.


15.9 No Monetary Value

Virtual Items are not legal tender, are not redeemable for money, and cannot be exchanged outside the SAWA platform. Any attempted sale or transfer outside SAWA is void.


15.10 Changes to Virtual Items Policy

SAWA may update Virtual Items terms at any time. Continued use of the platform after changes means you accept the revised terms.

  1. PUSH NOTIFICATIONS AND LOCATION-BASED FEATURES

You consent to receiving notifications and communications. Location-based features depend on device permissions and may be limited if disabled.

  1. ACCOUNT SUSPENSION AND TERMINATION

Sawa reserves the right, at its sole discretion, to suspend, restrict, or terminate your account at any time,

with or without notice, if:

• You violate these Terms or applicable laws

• Your conduct poses a safety, legal, or reputational risk

• Required for legal or regulatory compliance


You may terminate your account at any time through account settings. Termination does not relieve you of

obligations accrued prior to termination, and certain provisions shall survive termination.

  1. DISCLAIMER OF WARRANTIES

18.1 Service Provided “As Is”

The SAWA platform and all related services, content, features, and Virtual Items are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.


18.2 No Guarantees

To the fullest extent permitted by law, SAWA disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.


18.3 Availability and Accuracy

SAWA does not warrant that the Service will be uninterrupted, secure, error-free, or free from viruses or harmful components. SAWA makes no guarantees regarding the accuracy, reliability, completeness, or timeliness of any content available through the Service.


18.4 User Responsibility

Your use of SAWA is at your sole risk. You are solely responsible for any damage to your device, system, data, or business that results from use of the Service or downloading any material through SAWA.


18.5 Third-Party Content and Services

SAWA makes no warranty regarding products, services, or content provided by third parties through the platform and assumes no responsibility for their actions, availability, legality, or performance.


18.6 No Professional Advice

Any information provided on SAWA is for general informational purposes only and does not constitute legal, financial, medical, or professional advice. You should consult a qualified professional before making decisions based on information from the platform.


18.7 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such cases, SAWA’s warranties are limited to the minimum extent permitted by law.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Sawa shall not be liable for indirect, incidental, special, or consequential damages. Total liability shall not exceed the amount paid by you to Sawa in the preceding twelve (12) months.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Sawa Technologies Private Limited, its directors, officers, employees, affiliates, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Platform

• Your User Content

• Your violation of these Terms or applicable laws

• Your infringement of any third-party rights

  1. CHANGES TO TERMS

Sawa may update or modify these Terms from time to time to reflect changes in law, business practices, or Platform features. Material changes will be communicated via the Platform or other reasonable means. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.

  1. GOVERNING LAW AND JURISDICTION

These Terms and Conditions, and any dispute, claim, or controversy arising out of or relating to the SAWA platform, its services, or these Terms, shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the use of the SAWA platform shall be brought exclusively before the competent courts of the applicable jurisdiction, and you hereby consent to the personal jurisdiction and venue of such courts. Nothing in this section shall prevent SAWA from seeking injunctive or equitable relief in any jurisdiction to protect its intellectual property rights, confidential information, or enforce these Terms.

  1. DISPUTE RESOLUTION

23.1 Informal Resolution First


Sawa Technologies Private Limited is committed to resolving disputes in a fair, efficient, and cost-effective manner.


Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to:

  1. These Terms

  2. Your use of the Platform

  3. Any Paid Services, subscriptions, or Virtual Items

  4. Interactions with other users


by contacting Sawa directly at support@sawa.living with a written description of the issue. Both parties agree to make a good-faith effort to resolve the dispute informally within 30 days of receipt of such notice.


23.2 Agreement to Arbitration (Where Permitted by Law)


Except where prohibited by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be finally and exclusively resolved by arbitration, rather than in court.


Arbitration shall:

  1. Be conducted in accordance with the Arbitration and Conciliation Act, 1996 (India)

  2. Be conducted by a sole arbitrator mutually appointed by the parties

  3. Take place in [City], India

  4. Be conducted in the English language


The arbitrator’s decision shall be final and binding on both parties.


23.3 Waiver of Class and Representative Actions


To the maximum extent permitted by law, you agree that all disputes must be brought in an individual capacity only, and not as:

  1. A plaintiff or class member in any purported class action

  2. A collective, consolidated, or representative action


You expressly waive any right to participate in class actions, class arbitrations, or representative

proceedings against Sawa.


23.4 Exceptions to Arbitration


Notwithstanding the foregoing, either party may seek:

  1. Interim or injunctive relief

  2. Relief for intellectual property infringement

  3. Relief to prevent unauthorized use, disclosure, or misuse of data from a court of competent jurisdiction, without waiving the obligation to arbitrate other disputes.


23.5 Costs of Arbitration


Unless otherwise required by law:

  1. Each party shall bear its own legal costs

  2. Arbitration fees shall be shared equally, unless the arbitrator determines otherwise


Nothing in this section prevents a consumer from exercising rights available under applicable consumer protection laws.


23.6 Limitation Period for Claims


To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these

Terms or the Services must be brought within one (1) year after such claim arises, or it shall be

permanently barred.

  1. GOVERNING LAW

These Terms and Conditions, your access to and use of the SAWA platform, and any dispute, claim, or controversy arising out of or relating to the Services, the content, transactions, communications, or relationships formed through SAWA shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law principles. You agree that the laws of such jurisdiction shall apply to all matters relating to the interpretation, validity, performance, and enforcement of these Terms. Where permitted by law, the United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement. Nothing in this section shall limit SAWA’s right to seek injunctive, equitable, or protective relief in any court of competent jurisdiction to protect its intellectual property, confidential information, platform integrity, or users. If any portion of this clause is found unenforceable, the remaining provisions shall remain in full force and effect.

  1. JURISDICTION AND FORUM

25.1 Exclusive Jurisdiction

Any dispute, claim, or controversy arising out of or relating to these Terms, the SAWA platform, or the Services shall be subject to the exclusive jurisdiction of the competent courts of the applicable jurisdiction.


25.2 Venue

You agree that all legal actions or proceedings shall be brought only in the courts located within that jurisdiction, and you irrevocably consent to the personal jurisdiction and venue of such courts.


25.3 Waiver of Objections

You waive any objection based on lack of personal jurisdiction, improper venue, or forum non conveniens in connection with any action brought in such courts.


25.4 Equitable Relief

Nothing in this section shall prevent SAWA from seeking injunctive or equitable relief in any jurisdiction where necessary to protect its intellectual property, confidential information, platform security, or users.


25.5 Severability

If any part of this section is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.

  1. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of

competent jurisdiction, such provision shall be:

  1. Modified to the minimum extent necessary to make it enforceable, or

  2. Severed, if modification is not possible


The remaining provisions shall continue in full force and effect.

  1. NO WAIVER

The failure of SAWA to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of SAWA. No waiver of any breach or default shall be deemed a waiver of any subsequent breach or default. SAWA’s rights and remedies under these Terms are cumulative and not exclusive of any rights or remedies provided by law.

  1. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without prior written consent from Sawa. Sawa may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, restructuring, or sale of assets, without restriction.

  1. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Sawa regarding the use of the Platform and supersede all prior agreements or understandings.
